UNHRC60- Draft Resolution on Arbitrary Detention

On 6 October 2025, the United Nations Human Rights Council adopted draft resolution A/HRC/60/L.6 on arbitrary detention without a vote, stressing the vital role of the Working Group on Arbitrary Detention and taking note with interest of its latest annual report, which in 2024 saw 71 opinions adopted concerning 149 individuals and 102 allegation letters transmitted to 52 States, including Bangladesh.

The resolution requests States concerned to take account of the Working Group’s views, take appropriate steps to remedy the situation of persons arbitrarily deprived of their liberty, and inform the Group of measures taken. It further encourages all States to cooperate fully with the Working Group, especially by responding favourably to requests for country visits so as to carry out its mandate more effectively.

Noting with concern the persistently large proportion of unanswered urgent appeals, the Council urges States to address these appeals on a strictly humanitarian basis and under the regular complaint procedure. It also notes the Working Group’s efforts to elaborate basic principles and guidelines on remedies and procedures for persons deprived of liberty to bring proceedings before a court, welcomes the release of some individuals brought to its attention, and deplores unresolved cases.

Crucially, the resolution decides to extend the Working Group’s mandate for a further three years; notes the increasing volume of submissions and requests that the Group reduce its backlog and process new cases promptly; and, noting insufficient human resources despite a streamlined review process, requests the Secretary-General to ensure sufficient, assured, and predictable staffing.

The Bangladesh Society of International Law calls upon all national authorities to implement this resolution fully, align domestic practice with the Working Group’s recommendations, and strengthen cooperation to uphold the rule of law and protect fundamental human rights.
