Through its investigations on and since the the events of October 7th 2023, the Commission has concluded that Israel is committing genocide in Gaza, finding “reasonable grounds to conclude” that Israeli authorities have intentionally killed tens of thousands of Palestinian civilians, including women and children; caused serious bodily and mental harm through widespread bombardments, torture, and sexual violence; deliberately inflicted conditions of life calculated to destroy the Palestinian population, including the blockade of food, water, electricity, medicine, and humanitarian aid; and imposed measures intended to prevent births within the group.
The report stresses that prohibition of genocide is a peremptory norm of international law (jus cogens), binding on all States, and imposes obligations to prevent and punish genocide. It also highlights that the situation engages the responsibility of third States under the Genocide Convention.
This development follows ongoing proceedings before the International Court of Justice (ICJ) in South Africa v. Israel regarding Israel’s obligations under the Genocide Convention.
The Bangladesh Society of International Law (BSIL) strongly condemns the ongoing atrocities in Gaza and calls upon the international community to uphold its legal and moral duty to act. The deliberate targeting of civilians and systematic destruction of a people not only constitutes genocide under international law but represents a grave affront to humanity and the rule of law. Silence or inaction in the face of such crimes risks eroding the very foundations of international justice.
